Appeals Against Planning Decisions

A decision by the National Park Authority to:

  • impose conditions on a grant of planning permission or
  • refuse permission or
  • take formal enforcement action

can be challenged by the applicant.

Rights of appeal and details of how to appeal will be set out on the formal decision notice.  All those who have made representations on an application will be advised in writing of any appeal.

Appeals are decided by the Secretary of State or by a government-appointed Planning Inspector.  Appeal forms are available from the Planning Inspectorate.

The Planning Inspectorate also makes its appeals services available via the Planning Portal website, with discrete areas available both for the general public and for planning professionals.

The general public can find appeals guidance and can also make an appeal online.

Similarly, appeals guidance is provided for professional users and a separate page is available to provide the facility to make an appeal online.

The Planning Portal also provides access to the Planning Inspectorate's case search facility, which allows access to details of current appeal proceedings.

From 6th April 2009, a new fast-track system for dealing with Householder Appeals has been introduced nationally.  The Planning Inspectorate have the authority to assess each appeal lodged using certain published criteria and to decide if an appeal may be dealt with under the new streamlined process.
